By accessing trimiagloves.com or purchasing our products, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website.

Trimia Gloves are performance accessories designed for grip enhancement and general hand support during physical activity. We do not make any medical claims. Our products are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition or disease.

  1. Orders and Payment

By placing an order, you confirm that you are authorized to use the selected payment method. All prices are displayed in U.S. Dollars (USD). We reserve the right to cancel or refuse any order at our discretion, including in cases of pricing errors or suspected fraud.

  1. Intellectual Property

All content on this website — including text, images, logos, and graphics — is the property of Trimia d.o.o. and is protected by applicable intellectual property laws. Unauthorized reproduction or use is strictly prohibited.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, Trimia d.o.o., its directors, officers, employees, and agents shall not be liable for any claim, demand, loss, damage, cost, or expense of any nature whatsoever — whether direct, indirect, incidental, special, consequential, or punitive — arising out of or in connection with your use of this website, your purchase or use of our products, or your reliance on any information published on this website.

This limitation applies regardless of the legal theory under which such liability is claimed, including but not limited to contract, tort, negligence, strict liability, or any other basis, and even if Trimia d.o.o. has been advised of the possibility of such damages.

We expressly disclaim all liability arising from personal injury, property damage, loss of data, loss of revenue, or any other loss or harm, to the maximum extent permitted by law.

  1. Disclaimer of Warranties

This website and all products are provided on an "as is" and "as available" basis. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

  1. Indemnification

You agree to fully indemnify, defend, and hold harmless Trimia d.o.o. and its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — arising out of or related to your use of this website, your purchase or use of our products, your violation of these Terms, or your violation of any rights of a third party. This indemnification obligation survives the termination of these Terms and your use of the website.

  1. Mandatory Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT WAIVES YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

8.1 Mandatory Arbitration. Any dispute, claim, or controversy of any kind arising out of or relating to these Terms, your use of this website, or your purchase or use of our products shall be resolved exclusively by final and binding individual arbitration. The arbitration shall be conducted under the Rules of the International Chamber of Commerce (ICC). No dispute shall be brought before any court except as expressly provided in Section 8.4 below.

8.2 Class Action Waiver. You and Trimia d.o.o. irrevocably agree that all disputes will be resolved solely on an individual basis. You expressly and permanently waive any right to initiate, join, or participate in any class action, collective action, consolidated proceeding, or representative action of any kind against Trimia d.o.o. or its affiliates, officers, or employees.

8.3 No Representative Claims. You further waive any right to act as a private attorney general or to bring claims on behalf of the general public in any jurisdiction.

8.4 Exceptions. Either party may seek emergency injunctive relief from a court of competent jurisdiction solely to prevent irreparable harm pending resolution by arbitration. Such action shall not be deemed a waiver of the arbitration obligation.

8.5 Opt-Out. You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice to info@trimiagloves.com. Opting out does not affect any other provision of these Terms.

  1. Governing Law

These Terms of Service are governed exclusively by the laws of the Republic of Slovenia, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively before the competent courts of the Republic of Slovenia. You irrevocably submit to the personal jurisdiction of such courts and waive any objection to venue or jurisdiction therein.

To the extent that mandatory consumer protection provisions of U.S. federal or state law are applicable and cannot be waived, such provisions shall apply solely to the minimum extent required.

  1. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

  1. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Legal Disclaimer, constitute the entire agreement between you and Trimia d.o.o. regarding your use of this website and purchase of our products.

  1. Changes to These Terms

We reserve the right to update these Terms at any time without prior notice. Changes take effect immediately upon posting. Continued use of the website after changes are posted constitutes your acceptance of the updated Terms.
